1. INTRODUCTION
Welcome to the Enigma Medi Spa website and mobile application.
These Terms of Use (“Terms”) govern your access to and use of the Enigma Medi Spa website, mobile application, and related online services (collectively, the “Platform”).
The Platform is associated with the following two separate corporations and legal entities:
Enigma Medi Spa & Laser Center
and
Enigma Medi Spa & Plastic Surgery DBA Enigma Plastic Surgery
Services presented through the Platform may be offered or provided by either corporation, depending upon the service requested or provided.
For purposes of these Terms, references to “Enigma,” “we,” “us,” or “our” refer, as applicable, to the corporation receiving the relevant inquiry, operating the relevant portion of the Platform, or providing the applicable service.
After the initial identification above, Enigma Medi Spa & Plastic Surgery DBA Enigma Plastic Surgery is referred to in these Terms simply as “Enigma Plastic Surgery.”
By accessing or using the Platform, you agree to these Terms.
2. PURPOSE OF THE PLATFORM
The Platform provides information concerning Enigma’s medical, surgical, cosmetic, and aesthetic services and allows users to submit appointment inquiries or appointment requests.
The Platform may also provide general educational or informational material concerning treatments, procedures, services, providers, or other topics.
General Platform content is not intended to replace an individualized consultation with an appropriately qualified healthcare professional.
3. APPOINTMENT INQUIRIES AND REQUESTS
The Platform may allow users to submit appointment inquiries or request appointments for services offered by Enigma Medi Spa & Laser Center or Enigma Plastic Surgery.
Submitting an appointment inquiry, selecting a preferred date or time, or receiving an automated acknowledgment does not constitute a confirmed appointment.
An appointment is considered confirmed only after confirmation is provided by the appropriate Enigma entity or its authorized representative.
Requested appointment dates, times, providers, or services may not be available.
Enigma may contact you to:
- Respond to your appointment inquiry;
- Determine the appropriate service or provider;
- Discuss appointment availability;
- Offer alternative appointment dates or times;
- Confirm an appointment;
- Reschedule or cancel an appointment; or
- Provide administrative instructions related to an appointment.
4. NO PROVIDER-PATIENT RELATIONSHIP FROM GENERAL PLATFORM USE
Browsing the Platform, downloading the mobile application, reading general information, or submitting an appointment inquiry does not, by itself, establish a physician-patient or other healthcare provider-patient relationship.
A healthcare provider-patient relationship will be established only as permitted by applicable law and the applicable Enigma entity’s clinical procedures.
5. NO MEDICAL ADVICE THROUGH GENERAL PLATFORM CONTENT
General information appearing on the Platform is provided for informational and educational purposes.
It should not be interpreted as an individualized diagnosis, medical opinion, prescription, treatment recommendation, or substitute for professional medical advice.
A treatment or procedure appropriate for one individual may not be appropriate for another.
Treatment decisions should be made following an appropriate consultation and evaluation by a qualified healthcare professional.
6. MEDICAL EMERGENCIES
DO NOT USE THE WEBSITE, MOBILE APPLICATION, APPOINTMENT-INQUIRY FORM, EMAIL, TEXT MESSAGING, OR OTHER NON-EMERGENCY PLATFORM COMMUNICATIONS FOR A MEDICAL EMERGENCY.
If you believe you are experiencing a medical emergency, call 911 or seek immediate emergency medical attention.
Electronic communications and appointment inquiries may not be reviewed immediately and should not be relied upon for urgent medical needs.
7. TREATMENT INFORMATION AND RESULTS
Information concerning medical, surgical, cosmetic, aesthetic, laser, injectable, skincare, body, or other treatments and procedures is general information unless specifically provided to you by an appropriately qualified healthcare provider as part of your individual care.
Individual results vary.
Results may depend upon factors including:
- Individual anatomy;
- Age;
- Medical history;
- Skin type;
- Treatment selection;
- Surgical or treatment technique;
- Healing response;
- Compliance with pre-treatment and post-treatment instructions;
- Medications;
- Lifestyle; and
- Other individual circumstances.
Photographs, testimonials, before-and-after examples, reviews, or descriptions of previous results do not guarantee that another patient will receive identical or similar results.
8. INFORMATION PROVIDED BY USERS
You agree to provide accurate information when submitting an appointment inquiry or otherwise communicating through the Platform.
If you become a patient, accurate medical information may be important to the safety and appropriateness of treatment.
You are responsible for providing your healthcare provider with complete and accurate information requested during the appropriate patient intake, consultation, and treatment process.
9. NO PAYMENT PROCESSING THROUGH THE APP
The Enigma mobile application’s appointment-inquiry functionality does not process patient payments.
Submitting an appointment request through the Platform should not be interpreted as completing a purchase or payment transaction.
If a deposit or payment is required for an appointment, consultation, procedure, treatment, product, or other service, the applicable Enigma entity may provide separate payment instructions and applicable policies.
10. APPOINTMENT AND OFFICE POLICIES
Appointments may be subject to separate Enigma policies concerning matters including:
- Cancellations;
- Rescheduling;
- Late arrivals;
- No-shows;
- Consultation requirements;
- Deposits, where applicable; and
- Treatment or procedure-specific requirements.
Applicable policies may be communicated separately when an appointment is scheduled or confirmed.
11. COMMUNICATIONS
By providing a telephone number or email address in connection with an appointment inquiry, you authorize Enigma to use that information to respond to your request and communicate with you regarding appointment administration.
Such communications may include:
- Appointment confirmations;
- Appointment reminders;
- Scheduling changes;
- Rescheduling requests;
- Administrative instructions; and
- Responses to questions you submit.
Consent to receive unrelated marketing communications is not a condition of receiving medical or aesthetic services.
Separate consent will be obtained for marketing communications where required by applicable law.
12. USER ACCOUNTS
If the Platform allows users to create accounts, you are responsible for maintaining the confidentiality of your login credentials and for reasonable measures to prevent unauthorized access to your account.
You may not:
- Access another person’s account without authorization;
- Impersonate another individual;
- Share credentials for an unauthorized purpose; or
- Attempt to circumvent Platform security.
You should promptly contact Enigma if you believe your account or personal information has been accessed without authorization.
13. ACCEPTABLE USE
You may not use the Platform to:
- Violate applicable law;
- Submit fraudulent or intentionally misleading information;
- Impersonate another person;
- Attempt unauthorized access to Enigma systems;
- Introduce viruses, malware, or harmful software;
- Interfere with Platform operation or security;
- Scrape or systematically extract Platform information without authorization;
- Engage in threatening, abusive, fraudulent, or unlawful conduct; or
- Use Enigma’s name, content, or branding in a fraudulent or misleading manner.
14. INTELLECTUAL PROPERTY
Unless otherwise indicated, the Enigma name, logos, branding, Platform design, graphics, text, original photographs, videos, and other original content are owned by or licensed to the applicable Enigma entity and are protected by applicable intellectual-property laws.
The Platform is provided for personal, noncommercial use.
Platform content may not be copied, reproduced, modified, distributed, published, sold, or commercially exploited without appropriate authorization except as otherwise permitted by law.
15. PRIVACY
Use of the Platform is subject to the Enigma Medi Spa Privacy Policy.
Information constituting Protected Health Information may also be governed by the applicable healthcare provider’s Notice of Privacy Practices, HIPAA, and other applicable healthcare privacy laws.
16. THIRD-PARTY SERVICES
The Platform may contain links to or integrations with third-party websites, maps, social-media platforms, communication services, or other external services.
Enigma does not control independently operated third-party services and is not responsible for their availability, security, content, terms, or independent privacy practices.
Use of third-party services may be subject to separate terms and privacy policies.
17. PLATFORM AVAILABILITY
Enigma may modify, maintain, suspend, restrict, or discontinue Platform functionality when reasonably necessary for maintenance, security, legal compliance, technical, or operational reasons.
Enigma does not guarantee that the Platform will always operate without interruption, delay, or error.
18. DISCLAIMER
To the maximum extent permitted by applicable law, general Platform functionality and non-clinical Platform content are provided on an “as available” basis.
Nothing in these Terms is intended to eliminate, reduce, or modify any professional duty that an Enigma healthcare provider owes to a patient under applicable law.
Nothing in these Terms is intended to waive any patient or consumer right that cannot legally be waived.
19. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Enigma will not be liable for indirect, incidental, special, or consequential damages arising solely from access to, use of, or inability to access the general Platform.
This provision does not apply where liability cannot legally be excluded or limited and is not intended to limit legal or professional duties arising from healthcare actually provided to a patient.
20. SEPARATE CORPORATE ENTITIES
Enigma Medi Spa & Laser Center and Enigma Plastic Surgery are separate corporations and separate legal entities.
Use of common Enigma branding, a common website or mobile application, common administrative personnel, or other shared resources does not, by itself, alter the corporations’ separate legal status.
Each corporation is responsible for the professional and other services it provides, subject to applicable law.
The entity providing a particular service may be identified in appointment documentation, patient consent forms, medical records, invoices, or other applicable documentation.
Nothing contained on the Platform is intended, solely by reason of the Platform or common branding, to create a partnership or joint venture between the two corporations.
21. CHANGES TO THESE TERMS
Enigma may revise these Terms periodically to reflect changes in Platform functionality, technology, business practices, or applicable legal requirements.
The “Last Updated” date at the beginning of these Terms identifies the most recent revision.
When appropriate, material changes may also be communicated through the Platform or another reasonable method.
22. GOVERNING LAW
These Terms are governed by the laws of the Commonwealth of Pennsylvania, except where applicable federal law or another controlling law applies.
If any provision of these Terms is determined to be prohibited or unenforceable, that provision will be interpreted or limited to the extent necessary to comply with applicable law without invalidating the remaining provisions.
